Terms and Conditions:

This is the 'fine print' for our services, and the terms and conditions under which we offer them to our clients.

We offer services to the best of our ability, and in so doing strive for reliable operations. However, all services are certain to fail some of the time. When things do fail, we will do our best to keep you up-to-date about the nature of the outage; its cause; and expected duration. In acknowledging this risk of failure, we do not assume any form of liability for any disruption or loss of any kind you may experience relating to your VM servers or data hosted with us, regardless of the underlying cause.

We use servers and network infrastructure provided by a colocation service provider. Our servers are used solely for the purposes of VM and Data hosting / under our direct management and control.

Our colocation service provider offers 99.99% uptime reliability Service Levels on their Network, and makes use of redundant power and Cisco networking infrastructure to ensure high availability.

In using our services, our clients must agree to the following terms:

  • You will not do anything which is illegal, either in your country, our our country. This could include, but is not limited to: distribution of 'pirated' software or content for which you are not the license holder; warez; spam or other mail abuse services; IRC Bot or other IRC abuse services; denial of service or other activities which could be deemed 'hacker' activities.
  • You will not abuse the service in any manner which could affect other clients hosted on any of our servers in any way.
  • You will not attempt to circumvent, misuse or meddle in the operations of our servers or services, in any way; and strictly in our judgement.
  • If you fail to abide by these terms, your account may be terminated, without notice, and without any expectation of refund for outstanding balance that you may have pre-paid for services.
  • In the event you are unsatisfied with the service(s) we are providing, you are free to terminate your contract at any time. Due to the effort involved in setting up new client accounts; the lack of 'setup fees' associated with these services; as well as discounts provided for longer contract terms;any account which is terminated will have a minimum, non-refundable billable period equal to the initial minimum contract term (i.e., 3 months minimum for VM hosting services and 5 months minimum for data hosting services).
  • All accounts are to be pre-paid for their services. Accounts which are in arrears will have their associated VM(s) or Data Storage suspended from service. A payment reminder notice will be issued using contact information we have available. After a grace period of one week, all data will be permanently deleted, irrevocably, in order to free up this space for paying clients.

Privacy:

  • Information collected will be used only for designated purposes associated with the sale and delivery of services; and will not be disclosed to any third party at any time.
  • Your VM servers and your data remain yours at all times. We are not liable for, nor interested in, what you choose to store on your VM server or data hosting service, so long as it does not violate the terms and conditions detailed above. You are free to use encryption as you see fit to more absolutely ensure confidentiality of your data.
  • We will not be involved with the internal workings of your VM unless required to do so inherently under the terms of offering this service to you; or unless you specifically grant us such access in writing (typically if required to perform server management tasks, as part of paid server consulting / management services).
